    share this article! 自從樓市在2月底全面撤辣後,一手、二手新盤市場一度反彈大約3%,不過相隔不足四個月,樓價指數已經重返撤辣時的水平「打回原形」,樓市再次由蝕讓個案主導,代理報成交日日都有大蝕讓,燈神都覺得好冇癮。不過近期燈神就發現有一宗有趣個案,有網民於網上討論區發帖文,話自己層樓竟然被人霸佔,所以就發帖文求助盡快拎返層樓。 睇返事主所言,原來層樓本身由事主與其父親一齊居住,不過其後事主就遷走,層樓就由父親居住,但其父親及後就讓其女朋友一同入住。值得留意,層樓本身由該事主的嫲嫲持有,不過早前兩年已經轉名予事主。 父親離世後其女朋友不願搬遷 事主報警兼發律師信 但不幸的事就出現了,事主的父親於上個月不幸離世,但其女朋友卻繼續居住不願離開。據事主所拍攝的相片,單位內有大量雜物,聽聞仲飼養兩隻狗。最後,事主就話經準備出律師信向法庭申請收返層樓,又重申該名女士不是自己屋企人。 上述帖文引起了不少網民的討論,部份認為該名女士其實算係非法佔據單位,又建議事主報警,甚至可以為單位「CUT水CUT電」以逼走該名女士,仲話事主有權重返屋企,不過最好就等執達吏負責取回間屋。最終事主報警處理。 有網民發帖文,指自己父親離世後,由他持有的單位繼續被父親女朋友霸佔、不願搬遷,因此最終報警求助,並指發出律師信,以法律途徑取回單位。(網上討論區圖片) 佔用人料無合法權益逗留物業之內 事主可給予搬遷通知期 燈神睇到以上情況,覺得事主都有權可以取回單位,不過涉及法律問題,睇嚟都係問一問律師較好!老友香港調解仲裁中心主席蘇文傑律師就詳細講解了這個情況,若果上述物業的擁有權、全部權益都由事主一個人擁有,情況就會較為簡單。 蘇律師解釋指,事主父親在生時,應該是獲事主容許下居住於單位內,惟離世後,其女朋友理應沒有許何、沒有任何合法權益逗留在物業之內。因此事主可以給予足夠而又合理的通知期,通知對方遷出單位,若果女方不願遷出,則可以透過法律徑途申請收樓。 業主應盡快收回單位 避免「逆權侵佔」 其實香港過去也不時出現同類型情況,蘇律師就提醒,事主盡快取回單位是較好的做法,因為若果一直不作出行動收回單位,一直讓女方使用單位長達12年,就有機會被佔用人「逆權侵佔」,到時就會失去單位權益! 不可破壞門鎖、丟棄佔用人財產 否則反被告刑事毀壞、偷竊 此外,蘇律師都提醒事主,雖然擁有單位權益,但在取回單位時都留意不少事項,否則會遇上麻煩。例如事主取回單位時,不可以破壞單位門鎖,也可以隨意丟棄佔用人的財產,否則可能會犯上「刑事毀壞」及「偷竊」的罪行,到時就會反過來被控告。所以若果面對佔用人不願遷出時,就要通知執達吏負責收樓,如有需要更會連同警方一同收樓。 蘇文傑律師指出,業主應盡快收回單位 避免「逆權侵佔」。 業主遇租霸 收樓程序最快3個月 上述情況同時也令燈神想起一般住宅、舖位業主面對租霸時的應對方法。睇返中原測量師行的講解,業主或會遇上租霸​或租客欠租,甚至違反租約條款。為了保障利益,業主可以考慮向土地審裁處申請收樓令,以法律途徑中止租約並收回物業,追討欠租。 而整個收樓程序主要分為3個步驟。然而,每個案件的時間可能有所不同,但每個程序都需要一定時間,最快需要約3個月。 連續3日到欠租單位門口貼上通知書 其後到土審處宣誓 第一步是業主需要向土地審裁處提交申請通知書,連同加蓋印花的租約和其他租賃文件,一併交到審裁處登記。之後,業主需要將通知書副本寄給租客,並連續3日到欠租單位門口貼上通知書副本。完成後數天內,業主需要到土地審裁處宣誓。 第二步是申請判決書,大約需要2至3日,前提是欠租租客在收到申請通知書後七日內沒有提出反對。如果租客有反對,則需要再安排聆訊,大約需要半個月或更長的時間。 可由執達吏收回欠租單位 最後是上門收回單位。業主在獲得判決書後,需要申請收樓令狀,由執達吏執行法院命令來收回欠租單位。所需時間會視乎該區執達吏的排期,平均需要等待一至兩個月的時間。 土地審裁處位於油麻地加士居道38號。 ​ Nvidia破3萬億美元 黃仁勳晉身世界頂級富豪 靠一招爆紅|燈神郭晉安非商界「阿旺」 草姬上市神操作 揭示姊弟商業頭腦|燈神地產商發惡講明「追差價」 呂麗君撻訂4伙隨時輸多千萬|燈神何伯忘年戀《東張》收視未爆燈 遠低高峰、配股1億要善用|燈神東張何伯貪飲靚湯陷兩難 向細女討回450萬 何太恐失公屋|燈神鄧成波家族沽貨潮重新啟動? 靈魂人物離世後喪沽240億貨|燈神投資大富豪盈利破億、一年回本? 計劃書見錯漏小心提防|燈神希雲大廈小業主夢碎 昔日天價收購不再 併購17年臨門撻Q|燈神DONKI重組亞洲業務 遇港零售寒冬 日企擴展大計要收步?|燈神 Read More share this article!
